§ 1. Definitions
Seller – ARIO Event sp. z o.o. with its registered office in Katowice, as identified above.
Shop – the online shop operated by the Seller at ario.pl.
Customer – a natural person, legal person or organisational unit without legal personality to which the law grants legal capacity, entering into a contract with the Seller through the Shop.
Consumer – a natural person entering into a contract with the Seller for purposes not directly related to their business or professional activity.
Sole trader with consumer rights – a natural person entering into a contract directly related to their business activity where the contract is not of a professional nature for that person. Such a person is entitled to the rights described in § 7 and § 8 on the terms provided for a Consumer.
Product – a movable item offered in the Shop, in particular an inflatable advertising structure.
Made-to-order Product – a Product manufactured to the Customer's specification or clearly personalised, in particular a Product printed on the basis of artwork supplied by the Customer or made in a non-standard size or colour.
Order – the Customer's declaration of intent aimed at concluding a Sales Contract, submitted through the Shop.
Sales Contract – a contract for the sale of a Product concluded at a distance between the Customer and the Seller.
§ 2. General provisions
The Shop sells inflatable advertising structures: fan blown and sealed air tents, pop-up tents, start arches, advertising balloons, spheres, baubles, air dancers, inflatable columns, airwall screens, flags and promotional counters. Products are also manufactured with print based on artwork supplied by the Customer.
To use the Shop you need a device with internet access, a current web browser and an active e-mail account.
The Customer must not supply content of an unlawful nature.
Matters not governed by these Terms are subject to Polish law, in particular the Civil Code, the Consumer Rights Act of 30 May 2014 and the Act of 18 July 2002 on the provision of services by electronic means.
§ 3. Products and prices
Prices of Products shown in the Shop are expressed in Polish zloty and are gross prices – they include value added tax. The price shown next to a Product is the total price of that Product.
Delivery within the territory of Poland is free of charge. The cost of transport is included in the price of the Product, regardless of the value of the Order, the size of the Product or the place of delivery within Poland. The price shown next to a Product is therefore the amount the Customer will pay for the Product delivered to the address given in Poland.
Information about Products published in the Shop constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code and is not an offer.
The Seller also fulfils orders abroad. Outside Poland the price of the Product and the delivery cost are agreed individually, and the manner of concluding the contract is described in § 4.
The Seller reserves the right to change Product prices. A change does not affect Orders already accepted for fulfilment.
§ 4. Orders and conclusion of the contract
Orders may be placed 24 hours a day, seven days a week.
An Order is placed by selecting the Product and its configuration, providing the Customer's details and the delivery address, and confirming the Order using the button marked as an order with an obligation to pay. The basket handles delivery within Poland only; orders for delivery abroad are placed as described in paragraph 4.
Delivery within Poland. Delivery is free of charge, so the total amount payable is known at the moment the Order is placed and is shown in the basket summary. Placing an Order then constitutes an offer to conclude a Sales Contract made to the Seller by the Customer, and the button confirming the Order is marked as an order with an obligation to pay. The contract is concluded when the Seller sends confirmation of acceptance of the Order to the Customer's e-mail address.
Delivery outside Poland. The prices shown in the Shop apply to the Polish market; outside Poland the price of the Product and the cost of delivery are set individually. The Shop therefore does not accept orders for delivery outside Poland through the basket – such orders are handled on the basis of an enquiry. The Seller replies with a quotation stating the price of the Product, the cost of delivery and the lead time; the quotation is an offer by the Seller and binds the Seller for 7 days from being sent. The contract is concluded when the Customer accepts the quotation, which means confirming it by e-mail or paying the proforma invoice issued on the basis of it. Until acceptance the Customer is under no obligation to pay and may withdraw at no cost whatsoever.
For a Made-to-order Product the Customer supplies the artwork and the Seller prepares a visualisation for approval. Production starts once the Customer has approved the visualisation in writing. The lead time runs from the date of that approval.
The Seller may refuse to accept an Order where the artwork supplied infringes third-party rights, the law or accepted standards, and where the quality of the file makes printing impossible.
§ 5. Payment
The Seller offers one payment method: bank transfer to the account stated on the proforma invoice. The Shop does not use an electronic payment provider and does not accept payment by card, BLIK or cash on delivery.
Payment is made in advance, in the amount of 100% of the total – as stated in the confirmation of acceptance of the Order, or, for delivery outside Poland, in the quotation referred to in § 4. The Seller does not take partial deposits and does not offer instalments. Work on an Order begins once payment in full has been credited to the Seller's account.
The Seller issues an invoice for every Order.
§ 6. Fulfilment and delivery
The lead time for an Order is 10 working days. Every Product offered in the Shop is a Made-to-order Product – the Shop does not sell from stock, so there is no separate, shorter lead time for stock products.
The lead time starts on the working day following the day on which both of the following conditions have been met: payment in full has been credited to the Seller's account, and the Customer has approved in writing the visualisation referred to in § 4.
Delivery is made by a courier company or a carrier, to the address given by the Customer in the Order. The Seller selects the carrier to match the size of the consignment and names it in the dispatch confirmation.
Delivery within Poland is free of charge. The Seller adds no transport charges whatsoever, including surcharges for oversized consignments, pallet freight or delivery outside urban areas. Free delivery is neither a time-limited promotion nor subject to a minimum Order value – it applies to every Order delivered within Poland.
Delivery outside Poland is quoted individually, and the Seller states its cost in the quotation referred to in § 4, before the Customer becomes obliged to pay.
We recommend checking the condition of the parcel on receipt. Drawing up a damage report with the courier makes a claim easier to pursue but is not a condition of a complaint being considered.
§ 7. Right of withdrawal
A Consumer, and a sole trader with consumer rights, who has concluded a distance contract may withdraw from it without giving a reason within 14 days of taking possession of the Product, by submitting a statement to the Seller. Sending the statement before the deadline expires is sufficient to meet it.
The statement may be made using the form attached to these Terms, by e-mail to ario.biuro@gmail.com or in writing to the Seller's registered office.
In the event of withdrawal the Seller returns the payments received, including delivery costs up to the amount of the cheapest delivery method offered, within 14 days of receiving the statement. The Seller may withhold the refund until the Product is returned or proof of its dispatch is provided. The cost of returning the Product is borne by the Customer.
The right of withdrawal does not apply to Made-to-order Products. Under Article 38(1)(3) of the Polish Consumer Rights Act there is no right of withdrawal from a distance contract where the subject of the performance is a non-prefabricated item manufactured to the consumer's specification or serving to satisfy their individualised needs. This applies in particular to Products printed on the basis of the Customer's artwork and to Products in a non-standard size or colour. Information about the absence of the right of withdrawal is presented with the Product before the Order is placed, and the Customer confirms having read it when placing the Order.
§ 8. Complaints
The Seller is obliged to deliver a Product that conforms with the contract.
Towards a Consumer and a sole trader with consumer rights the Seller is liable for lack of conformity of the Product with the contract under Chapter 5a of the Polish Consumer Rights Act. The Seller is liable for a lack of conformity existing at the time of delivery and revealed within two years of that time.
Where a Product does not conform with the contract, the Customer may request its repair or replacement. If repair or replacement is impossible or would involve excessive costs, the Customer may make a statement requesting a price reduction or withdrawing from the contract.
Complaints should be sent to ario.biuro@gmail.com or in writing to the Seller's registered office. A complaint should include the Customer's details, the Order number, a description of the non-conformity and the Customer's request. Photographs are helpful.
The Seller responds to a Consumer's complaint within 14 days of receiving it. Failure to respond within that period means the complaint is deemed justified.
In contracts with Customers who are neither Consumers nor sole traders with consumer rights, the Seller's liability under the statutory warranty for defects is excluded pursuant to Article 558 § 1 of the Polish Civil Code.
§ 9. Guarantee
The Seller grants a guarantee on Products for 24 months from the date the Product is released, and on advertising flags and promotional counters for 12 months.
The guarantee covers defects in materials and workmanship. It does not cover damage resulting from use contrary to the instructions, in particular operation in wind speeds exceeding the value stated in the Product instructions, incorrect anchoring, packing the Product while wet, or mechanical damage arising after the Product was released.
The guarantee neither excludes nor limits the Customer's rights arising from the provisions on lack of conformity of the Product with the contract.
§ 10. Out-of-court dispute resolution
A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular by:
a) applying to the permanent consumer arbitration court operating at the regional inspectorate of the Trade Inspection Authority,
b) applying to the regional inspector of the Trade Inspection Authority to open mediation proceedings,
c) using the free assistance of a district or municipal consumer ombudsman or of a social organisation whose statutory tasks include consumer protection.
Information on access to these procedures is available from the Polish Office of Competition and Consumer Protection.
§ 11. Personal data
The controller of Customers' personal data is the Seller. The rules of processing, the legal bases, the recipients of data and the rights of data subjects are described in the Privacy Policy.
§ 12. Copyright and artwork
Content published in the Shop, including descriptions, photographs and graphics, is protected by copyright. Its use and distribution without the Seller's consent is prohibited.
A Customer supplying artwork declares that they hold the rights to use it to the extent necessary to fulfil the Order, including rights to any trade marks and likenesses it contains. The Customer releases the Seller from liability for third-party claims arising from the use of the artwork supplied.
The Seller may publish photographs of completed Products in the Shop portfolio, on social media and in marketing materials. Where a Product carries the Customer's trade mark, logo or artwork, publication requires the Customer's separate consent, given when the Order is placed. Refusing consent has no effect on acceptance of the Order, its price or its lead time.
Consent may be withdrawn at any time by sending a message to ario.biuro@gmail.com. The Seller removes the material from the channels under its control within 14 days of receiving the objection. The Seller does not publish the Customer's details or any part of the artwork beyond the appearance of the Product itself.
§ 13. Final provisions
The Seller may amend these Terms for important reasons, in particular a change in the law or in the way services are provided. Customers are informed of any amendment no later than 14 days before it takes effect. Orders placed before the amendment takes effect are fulfilled under the previous Terms.
Disputes with the Seller in which the Customer is a Consumer are resolved by the court having jurisdiction under the Polish Code of Civil Procedure. Disputes with Customers who are not Consumers are resolved by the court having jurisdiction over the Seller's registered office.
These Terms are available in the Shop in a form allowing them to be downloaded, reproduced and stored.
These Terms take effect on 1 September 2026.
